Welcome to Toppers Academy Indiranagar.These Terms & Conditions (“Terms”, “Terms and Conditions” or “Agreement”) govern your access to and use of the educational services, communication services, website, digital platforms, student-support channels, messaging services and other facilities made available by Toppers Academy Indiranagar (“Toppers Academy”, “we”, “us”, “our” or “the Academy”).Toppers Academy Indiranagar operates as a proprietorship engaged in educational and related academic services. Depending on the services offered from time to time, the Academy may communicate with students, parents, guardians, prospective students and other authorised users through telephone, email, WhatsApp, WhatsApp Business/Official API, RCS for Business, SMS, web-based communication and other authorised communication channels.These Terms are intended to establish clear expectations regarding the use of our services and communication channels. By accessing our website, registering for a course, contacting us, submitting an enquiry, subscribing to communications, making a payment, or otherwise using our services, you acknowledge that you have read and understood these Terms.Where a separate enrolment form, admission agreement, fee schedule, service-specific agreement or written communication contains additional terms, those terms may apply to the relevant service. If there is an inconsistency, the specific written agreement applicable to that service will prevail to the extent of the inconsistency.

2. DefinitionsFor purposes of these Terms:“Academy” means Toppers Academy Indiranagar.“User”, “you” or “your” means any person who accesses our website, communicates with us, submits an enquiry, registers for a service, purchases an educational service, or otherwise interacts with the Academy.“Student” means an individual enrolled or intending to enrol in an educational programme, course, class, training service or related offering.“Parent/Guardian” means a parent or legally authorised guardian acting for a student where applicable.“Services” means educational classes, academic guidance, coaching, training, study assistance, counselling, student support, educational information and other services offered by Toppers Academy Indiranagar.“WhatsApp Services” means business communications made through WhatsApp Business or an authorised WhatsApp Business Platform/Official API integration.“RCS” means Rich Communication Services and, where applicable, RCS for Business messaging services.“Communication” means any message, notification, reminder, update, enquiry response, educational communication, service communication, promotional communication or other authorised communication sent through email, telephone, WhatsApp, RCS, SMS or another supported channel.“Third-Party Provider” means an external technology, communication, payment, hosting, messaging, analytics or service provider used by the Academy.

3. Acceptance of TermsBy using the services of Toppers Academy Indiranagar, you agree to comply with these Terms.If you do not agree with these Terms, you should not use the relevant service or provide information for the purpose of receiving that service.Where registration or enrolment is completed on behalf of a student by a parent or guardian, the person completing the registration confirms that they have the authority to provide the information and accept applicable terms on behalf of the student.Your continued use of our services following publication of updated Terms may constitute acceptance of the revised Terms, subject to applicable law.

4. Description of ServicesToppers Academy Indiranagar provides educational and academic services. The exact nature, duration, curriculum, schedule, delivery method and fees of a service may vary according to the particular programme.Services may include, where offered:Educational classes and coaching;Academic guidance;Examination preparation;Student support;Course-related information;Educational counselling;Study materials or educational resources;Course schedules and reminders;Student or parent communication;Online or digital educational support; andOther education-related services communicated by the Academy.The Academy may modify, discontinue or introduce services where reasonably necessary, including because of academic requirements, operational considerations, technology changes or regulatory requirements.No statement on our website or through a communication channel should be interpreted as a guarantee of a particular examination result, rank, admission, employment outcome or academic performance unless expressly stated in a written agreement.

5. EligibilityOur services are intended for individuals who are legally capable of entering into applicable agreements or who are represented by an appropriate parent or guardian.For students who are minors, registration, enrolment, consent or payment may need to be completed or authorised by a parent or lawful guardian in accordance with applicable law.Users must provide accurate and truthful information when interacting with Toppers Academy Indiranagar.We reserve the right to decline, suspend or terminate access to a service where information provided is materially inaccurate, fraudulent, misleading or otherwise unlawful.

6. Account RegistrationCertain services may require registration or submission of information.You agree to provide information that is accurate, complete and reasonably current. User ResponsibilitiesUsers agree to use our services lawfully and responsibly.You must not:Provide knowingly false or misleading information;Impersonate another person;Attempt to gain unauthorised access to our systems;Interfere with website or communication infrastructure;Upload malicious code or harmful material;Use our communication channels for spam or unlawful purposes;Copy or redistribute protected educational materials without permission;Harass Academy personnel, students or other users;Use automated systems to misuse communication channels;Use WhatsApp or RCS communications for unlawful, fraudulent or misleading activities; orViolate applicable Indian laws or the rules of any relevant communication platform.Users are responsible for maintaining the confidentiality of information received through their accounts or authorised communication channels.

8. Payment & Billing TermsWhere a service requires payment, the applicable fee will be communicated to the user before or at the time of enrolment or purchase.Fees may depend on the course, duration, programme, facilities, study format or other applicable factors.Payments may be processed through third-party payment providers. The Academy does not ordinarily receive or store complete payment-card information where payment processing is handled directly by an authorised payment service provider.Users are responsible for paying applicable fees by the due date.Taxes, government charges or other statutory amounts, where applicable, may be included in or added to the stated price in accordance with applicable law.A payment confirmation, receipt, invoice or other transaction record may be provided through an appropriate communication channel.

9. Subscription Renewal & TerminationWhere the Academy offers a recurring service or subscription, the applicable renewal period, charges and cancellation conditions will be communicated before subscription commencement.A subscription does not automatically renew unless an applicable recurring arrangement has been expressly communicated and permitted.The Academy may suspend or terminate a service for non-payment, misuse, violation of these Terms, fraudulent conduct, legal requirements or operational reasons.Users may request cancellation by contacting the Academy through the contact details stated in these Terms.Refunds, where applicable, will be governed by the relevant course, enrolment, payment or refund policy communicated at the time of purchase.Termination does not automatically extinguish obligations that by their nature are intended to survive termination, including intellectual property, confidentiality, payment obligations and applicable limitations of liability.

10. Use of WhatsApp Official API & RCSToppers Academy Indiranagar may use WhatsApp Business/Official API services and RCS for Business to communicate with students, parents, prospective students and other authorised recipients.These channels may be used for legitimate business and educational purposes, including:Admission-related communication;Enquiry responses;Course information;Class or schedule reminders;Important educational updates;Support communications;Payment-related notifications;Service notifications;Appointment or counselling reminders; andOther communications reasonably connected with the Academy’s services.Use of WhatsApp and RCS is subject to the applicable policies, technical requirements and enforcement mechanisms of the respective platforms and service providers.For RCS, Google documentation describes business agents as capable of receiving user messages and events through webhooks and processing text, locations, files and other supported content. RCS agents may also be subject to verification, launch and carrier requirements.The Academy does not control the operation of third-party messaging networks and therefore cannot guarantee that every message will be delivered, displayed identically, or delivered within a particular period.

11. Message Delivery & Compliance PolicyToppers Academy Indiranagar aims to send communications responsibly and only for legitimate purposes.We will take reasonable steps to ensure that messages are relevant, appropriately identified and consistent with applicable communication-platform policies.Users should not consider every message to be guaranteed delivery. Delivery may be affected by:Network availability;Recipient device settings;Mobile operator infrastructure;Platform outages;Spam or abuse controls;Recipient blocking;Invalid or inactive numbers;Message-format limitations;Carrier restrictions;Platform policy enforcement; orOther technical circumstances outside the Academy’s control.Recipients may be given appropriate methods to stop or limit promotional communications where required.The Academy does not knowingly use WhatsApp or RCS to distribute unlawful, fraudulent, deceptive or prohibited content.Promotional messaging, where used, will be subject to applicable consent, opt-out and platform requirements.

12. Intellectual Property RightsUnless otherwise stated, educational content, website text, branding, logos, graphics, course materials, documents, presentations, videos, designs and other materials supplied by Toppers Academy Indiranagar are owned by or licensed to the Academy.Access to educational material does not transfer ownership to the user.Users may use materials solely for their permitted personal educational purposes unless written permission states otherwise.Users must not reproduce, sell, publicly distribute, commercially exploit, upload, modify or republish Academy materials without prior written authorisation.Nothing in these Terms grants a licence to use the Academy’s name, trademarks, logos or branding except as expressly permitted.

ConfidentialityThe Academy may receive confidential or private information from students, parents and users in connection with its services.We will take reasonable steps to treat such information appropriately and in accordance with applicable law and our Privacy Policy.Users must similarly respect confidential information belonging to the Academy or other users.Confidentiality obligations do not apply to information that is publicly available through no breach of confidentiality, independently developed, lawfully received from another source, or required to be disclosed under applicable law.

14. Disclaimer of WarrantiesToppers Academy Indiranagar provides educational services with reasonable care and in good faith. However, educational outcomes depend on many factors beyond the Academy’s control.Except where expressly required by applicable law, we do not guarantee:A specific examination score;A specific rank;Admission to a particular institution;Employment;A particular financial outcome;Uninterrupted availability of digital services;Continuous availability of WhatsApp, RCS or third-party systems; orError-free operation of all technology.Third-party platforms are operated independently by their respective providers.

15. Limitation of LiabilityTo the maximum extent permitted under applicable Indian law, Toppers Academy Indiranagar will not be responsible for indirect, incidental, consequential or unforeseeable losses arising from use of the services.This may include losses caused by circumstances outside our reasonable control, such as internet outages, telecommunications failures, third-party platform interruptions, device failures or unauthorised access caused by circumstances beyond reasonable security measures.Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable Indian law.Where liability is legally established, the extent of liability will be determined in accordance with applicable law and the circumstances of the claim.

16. IndemnificationTo the extent permitted by law, you agree to indemnify and hold harmless Toppers Academy Indiranagar and its proprietor, personnel and authorised representatives from claims, losses, liabilities or expenses arising from your unlawful use of the services, violation of these Terms, infringement of third-party rights, fraudulent conduct or misuse of communication services.This provision does not require a user to indemnify the Academy for losses caused by the Academy’s own unlawful conduct.

17. Governing Law (India)These Terms are governed by the laws of India.Subject to applicable law, disputes relating to these Terms or the services of Toppers Academy Indiranagar shall be subject to the jurisdiction of the competent courts having jurisdiction over Nashik, Maharashtra.Nothing in this section prevents a consumer or other person from exercising a statutory right to approach a forum, authority or court that has jurisdiction under mandatory applicable law.

18. Changes to TermsToppers Academy Indiranagar may update these Terms when necessary to reflect changes in services, technology, legal requirements, communication platforms or business practices.The updated version will be published through an appropriate website or communication channel.The revised Terms will apply from the stated effective date.Where a change materially affects existing users and applicable law requires additional notice or consent, the Academy will take reasonable steps to provide such notice or obtain such consent.
